1. Provider and scope
These terms apply to balls-deep.net, the Balls Deep Discord community, connected DayZ servers and digital in-game benefits supplied by Maurice Unterhofer, whose contact details appear in the Imprint. Separate terms apply to the subscription service at bot.balls-deep.net.
2. Community access
Access to the website and public community areas is generally free. Access to Discord or a game server may require accounts with independent third parties such as Discord, PlayStation Network, DayZ and Nitrado. Their terms also apply. There is no entitlement to uninterrupted access, a particular server configuration, player count or feature.
3. Rules and moderation
Users must follow the published server and community rules and must not cheat, exploit bugs, evade sanctions, harass others, disrupt services or misuse personal data. We may warn, restrict, remove or ban users where reasonably necessary to enforce the rules, protect users or secure the service. Mandatory consumer rights remain unaffected.
4. Digital in-game benefits
Support contributions may include clearly described digital in-game benefits. Benefits are non-transferable unless the offer states otherwise, usable only within the stated Balls Deep environment, have no cash value and cannot be redeemed for money. The product description shown before checkout determines the content, server, duration and delivery conditions.
Game wipes, maintenance, balance changes and third-party service changes may affect availability. We will not remove already acquired contractual rights without a valid reason; statutory warranty rights remain unaffected.
5. Orders and payment
Orders are placed through the Tip4Serv storefront. The displayed product, total price and checkout information form part of the order. A contract is concluded when the order is accepted or the digital benefit is delivered. Payment processing is handled by Tip4Serv and the selected payment provider.
6. Availability and changes
We may maintain, update or discontinue free community features and adjust game balancing. Paid benefits are supplied as described for their agreed period. Temporary interruptions caused by maintenance, security incidents, third-party outages or force majeure do not automatically create a refund right; your mandatory legal remedies remain unaffected.
7. Liability
We are liable without limitation for intent and gross negligence, injury to life, body or health, fraudulent concealment, assumed guarantees and liability required by law. For slight negligence involving an essential contractual obligation, liability is limited to the typical foreseeable damage. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
8. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections of the country in which you habitually reside.
